Contractual terms for Cranfield Aviation theory training, digital learning services and related training support, with clear information on cancellation and statutory withdrawal rights.

Global EASA training

Consumer rights preserved
Regulatory training environment

Professional training terms for an international ATO environment.

These Terms & Conditions apply to training and related services supplied by Cranfield Aviation Training School (Deutschland) GmbH unless a course-specific training agreement, offer or order confirmation provides more specific terms. Mandatory consumer, distance-learning and aviation-regulatory provisions always take precedence.

1. Contracting party and scope

Your contracting party is Cranfield Aviation Training School (Deutschland) GmbH, Emil-Figge-Str. 76–80, 44227 Dortmund, Germany. These terms apply to theoretical aviation training, distance-learning programmes, online learning access, brush-up or classroom instruction, training support and related digital services supplied by Cranfield Aviation.

Course-specific documents form part of the contract. If a course-specific training agreement conflicts with these general terms, the specific agreement prevails to the extent legally permissible.

2. Course content, regulatory framework and admission requirements

Training is delivered in accordance with the course description, the applicable approved training programme and the regulatory requirements in force for the relevant licence, rating or examination route. Where a programme is subject to approval under German distance-learning law, the applicable statutory and approval requirements remain binding.

The student is responsible for ensuring that personal licensing, medical, identity, language, experience and other admission prerequisites are met and for providing complete and accurate documents in due time. Cranfield may require evidence before issuing training confirmations, examination recommendations or authority-related documentation.

External examination authorities, licensing authorities and other competent bodies make their own decisions. Cranfield cannot bind an authority or guarantee that an authority will accept an application, grant examination admission, issue a licence or rating, or maintain a particular regulatory route.

3. Training delivery and digital access

Training may include web-based training, study guides, digital documents, question banks, instructor support, progress tests, school examinations, live online instruction and classroom or brush-up sessions. The exact scope is determined by the course-specific agreement.

Digital access is personal and non-transferable. Students must protect credentials and may not share accounts, reproduce substantial parts of protected training material, distribute questions or course content, or use Cranfield material for commercial training without written permission.

Cranfield may reasonably update learning content, question material, course sequencing, systems, procedures or delivery methods where necessary to maintain regulatory compliance, technical security, quality or operational efficiency, provided the essential contracted training service is not materially reduced.

4. Student obligations and progress

The student must actively participate, complete required self-study, attend mandatory instruction, submit required documents and complete prescribed progress tests or school examinations. Internal pass standards, course completion criteria and examination-readiness requirements are governed by the applicable approved training programme and course-specific documentation.

Failure to study, attend, provide required documents, pass internal assessments or meet regulatory prerequisites can delay or prevent completion. Additional tuition requested or required beyond the included scope may be charged separately where legally permitted and clearly agreed in advance.

5. Fees and payment

Course fees are stated in the course-specific agreement, offer or order confirmation. Unless expressly included, external authority fees, examination fees, travel, accommodation, medical examinations, licensing costs, third-party materials and other personal expenses are not included.

Where the German Distance Learning Protection Act (FernUSG) applies, statutory rules on instalments and advance payments apply. In particular, payment instalments may not cover more than the legally permitted period, and Cranfield does not charge a separate enrolment or registration fee where such a fee is prohibited by law.

If an undisputed payment is overdue, Cranfield may, after appropriate notice and subject to mandatory law, temporarily suspend access to non-completed services until payment is made. Statutory rights regarding default remain unaffected.

6. Scheduling, availability and operational changes

Published training dates, instructor assignments, platforms and locations may be changed for operational, technical, regulatory or safety reasons where reasonably necessary. Cranfield will use reasonable efforts to provide an equivalent alternative. Students remain responsible for arranging travel only after checking the current confirmed schedule.

Temporary interruptions caused by maintenance, communications failures, force majeure, authority action or events outside Cranfield's reasonable control do not create a guarantee of uninterrupted availability. Cranfield will use reasonable efforts to restore or provide the affected service.

7. No guarantee of successful completion

Training is a professional preparation service — not a guarantee of a regulatory outcome.

Cranfield prepares students for the relevant theoretical requirements and supports them through the agreed training process. We do not guarantee examination admission, a first-time pass, successful course completion, completion within a particular personal timeframe, the issue of a licence or rating, employment, or any other result dependent on the student, an examination body, an aviation authority or third party.

The training is designed to prepare the student carefully and professionally for the relevant theoretical requirements. Successful completion, examination admission, examination results, licensing decisions and other regulatory outcomes remain dependent on the student and the competent authorities or examination bodies.

8. Termination and statutory cancellation rights

Where the FernUSG applies, the student retains the statutory termination rights, including the right to terminate without giving reasons at the times and with the notice periods prescribed by law. Termination may be made in text form. Mandatory rights to terminate for cause remain unaffected.

Cranfield may terminate or suspend a contract only where permitted by law, including for material breach, persistent non-payment following notice, serious misuse of training systems or other important cause. Any statutory proportional settlement on termination remains unaffected.

9. Intellectual property and confidentiality

All course materials, question banks, books, study guides, graphics, recordings, software interfaces and other training content remain protected by copyright and other intellectual-property rights. The student receives a limited, personal right to use the material for the contracted training. Copying, systematic extraction, redistribution, publication, resale or use to train third parties is prohibited unless expressly permitted in writing.

10. Liability

Liability is governed by applicable statutory law. Nothing in these terms excludes or restricts liability where such exclusion or restriction would be prohibited, including mandatory participant protections under the FernUSG.

Cranfield is not responsible for decisions or acts of independent aviation authorities, examination bodies, licensing authorities, third-party service providers or other organisations outside Cranfield's control, except where applicable law attributes responsibility to Cranfield.

11. Governing law and jurisdiction

German law applies, subject to mandatory consumer-protection rules that cannot lawfully be excluded. For consumers, the legally prescribed place of jurisdiction applies. For distance-learning contracts subject to the FernUSG, the mandatory jurisdiction rules of the FernUSG remain unaffected. For merchants, legal entities under public law or comparable business customers, Dortmund may be agreed as the place of jurisdiction to the extent legally permissible.

Consumer withdrawal

Right of Withdrawal

If you are a consumer and a statutory right of withdrawal applies, you generally have 14 days to withdraw from the contract without giving any reason. The period is determined by the applicable statutory rules and does not begin before the legally required information has been provided. Special rules may apply to distance-learning contracts paid by instalments.

How to withdraw

You may withdraw by making any clear statement informing us of your decision. An email is sufficient. Please send it to info@theorieschule.aero. You do not need to give a reason. Sending the withdrawal before the deadline is sufficient to meet the deadline.

Withdraw by email

Early start at your request. You may expressly request that Cranfield starts providing the contracted services before the withdrawal period expires. If you later exercise a valid withdrawal right, Cranfield may claim only the statutory, proportionate compensation for services actually provided up to the time of withdrawal, where the legal requirements for such compensation are met. The calculation is based on the agreed total price and the proportion of the contracted service actually supplied.

Early-start compensation. If you request performance before the end of the withdrawal period and later validly withdraw, any compensation due is limited to the proportionate value of services actually provided up to the time of withdrawal, as permitted by applicable law. No separate enrolment or registration fee is charged where such a fee is prohibited by law.

If the service is fully performed during the withdrawal period at your express request, the withdrawal right may expire where the statutory conditions for early expiry are fulfilled. Access to digital learning material does not by itself override mandatory consumer rights.
